Representing everyone from Ben & Jerry’s to the Louis Dreyfus Company, Nadia I. Gire’s broad range of experience lends to her bright litigation career. In her ten-plus years as an attorney, Ms. Gire has tried cases in state and federal courts yielding extremely favorable results for her clients, from zero-dollar defense verdicts to hundred-million-dollar resolutions. Ms. Gire’s trial and arbitration experience includes a number of complex, multi-party matters and weeks-long federal jury trials.
Her practice includes business and commercial disputes, as well as broad-based insurance coverage litigation and first and third-party insurance work. Ms. Gire has been named a Texas SuperLawyer and BestLawyer in the field of insurance coverage since 2019 and has represented clients in several high-profile insurance coverage suits nationwide.

The Power of Bracketing in Mediation
​
When parties in a mediation find themselves entrenched in disparate positions, with neither willing to budge, resulting in a deadlock, enter bracketing—a conditional offer designed to catalyze movement. The idea is simple, one party will propose a substantial adjustment to X if, in return, the other party reciprocates with a corresponding adjustment to Y. In essence, progress from one side hinges upon reciprocal movement from the other.

Why Bracket?
​
Bracketing is useful for a myriad of strategic purposes, some of which include the following:

Breaking Stalemates: When negotiations stall in a cycle of reactive posturing, bracketing disrupts the impasse and fosters progress.

Facilitating Settlement Discussions: Bracket exchanges provide mediators with insight into each party's “end game,” facilitating candid discussions about settlement prospects.

Signaling Settlement Positions: Bracketing enables parties to communicate desired endpoints while safeguarding against commitment until reciprocal movement is assured.

Accelerating Negotiations: Acceptance of a proposed bracket—perhaps with minor revisions—propels the case towards resolution, bypassing incremental moves and expediting the settlement process.

Sustaining Engagement: Ultimately, by reigniting parties' commitment to the settlement process, bracketing mitigates frustration, diffuses tension, and rejuvenates hope.
Bracketing in Action

For example, a scenario where the plaintiff demands $300,000 while the defendant offers $50,000. The plaintiff might propose descending to $200,000 contingent upon the defendant ascending to $100,000, creating a bracket of $200K/$100K. In response, the defendant may counter with a proposal for the plaintiff to decrease to $150,000 if the defense increases to $75,000, resulting in a counter-bracket of $150K/$75K.

While these brackets may initially appear irreconcilable, they demonstrate crucial insights. The plaintiff suggests a settlement landing zone between $200,000 and $100,000, while the defense indicates a landing zone between $150,000 and $75,000. Calculating the mid-points of these brackets reveals potential convergence: the plaintiff may signal willingness to settle around $150,000 while the defendant hints at $112,500. By “bracketing the brackets,” parties may find themselves only $37,500 apart. Considering the mid-point of the mid-points ($18,750) unveils a potential resolution between the parties.

A Practical Tip
​
To wield brackets effectively, adept calculation of mid-points is indispensable. A simple mathematical trick—adding the bracket endpoints and halving the total—yields the mid-point. For instance, in a $250,000/$175,000 bracket, the mid-point is $100,000.

Conclusion
​
While brackets may not suit every mediation or negotiation, they represent a potent tool for overcoming impasses and revitalizing progress in mediation. When skillfully employed, bracketing can serve as a linchpin for achieving mutually beneficial resolutions.
